Assault Charges

Assault charges in New South Wales range from common assault, which is generally dealt with in the Local Court, to serious offences such as assault occasioning actual bodily harm, assault occasioning grievous bodily harm, and wounding, which may be dealt with in the District Court and carry significant terms of imprisonment.

Under the Crimes Act 1900 (NSW), an assault occurs when a person intentionally or recklessly causes another person to apprehend immediate and unlawful violence, or when unlawful force is applied to another person. The severity of the charge depends on factors including the injuries caused, the use of weapons, and whether the victim was a police officer, emergency worker, or other protected person.

Common assault carries a maximum penalty of two years imprisonment. Assault occasioning actual bodily harm carries a maximum of five years, or seven years if committed in company. Assault occasioning grievous bodily harm or wounding with intent can carry maximum penalties of up to 25 years imprisonment in the most serious cases.

Defences to assault charges may include self-defence, defence of another person, consent (in limited circumstances), or that the prosecution cannot prove the essential elements of the offence beyond reasonable doubt. The appropriate defence will depend on the specific circumstances of your matter.
