Theft & Property Offences
Property offences encompass a range of criminal conduct including stealing, break and enter, receiving stolen goods, and malicious damage. These offences are governed by the Crimes Act 1900 (NSW) and carry penalties that vary depending on the circumstances and value of the property involved.
Larceny (stealing) occurs when a person takes property belonging to another with the intention of permanently depriving the owner of that property. The maximum penalty for larceny is five years imprisonment, though many larceny matters, including shoplifting, are dealt with promptly in the Local Court. Factors such as the value of the goods, whether force was used, and the offender’s prior record influence both the court in which the matter is heard and the likely sentence.
Breaking and entering offences involve entering a building or dwelling with the intention of committing a serious indictable offence. Aggravated breaking and entering, such as where a weapon is used or a person is injured, carries a maximum penalty of 20 years imprisonment. Even non-aggravated breaking and entering carries a maximum of 14 years.
Receiving stolen goods, knowingly possessing property that has been stolen, is also a serious offence. The penalty mirrors that for the underlying theft offence, and the prosecution must prove that the accused knew or believed the goods were stolen.
